These Terms of Service (“Terms”) govern your access to and use of the Ferro Racing website, products, and services (collectively, the “Services”). The Services are operated by Ferro Racing (“we”, “us”, or “our”).

By accessing our website or purchasing from us, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

1. Eligibility

By using the Services, you confirm that you are at least 18 years old or the age of majority in your jurisdiction, and that you have the legal capacity to enter into a binding agreement.

2. Products and Services

Ferro Racing offers made-to-order products that are manufactured and produced only after an order has been placed.

All product descriptions, images, and specifications are provided for informational purposes. We reserve the right to modify or discontinue any product at any time without notice.

 

Custom Logo & Design Disclaimer

  1. Customers may submit logos, images, or designs for use on products. All submissions must be original or properly authorized by the owner.

  2. By submitting a design, the customer confirms they have the legal right to use it.

  3. The business does not claim ownership, endorse, or have any affiliation with logos or designs provided.

  4. All designs are produced strictly at the customer’s request. The business is not responsible for any legal claims arising from the use of third-party intellectual property.

  5. The business reserves the right to refuse production of designs that appear to infringe on third-party rights.

3. Orders and Acceptance

  • Placing an order constitutes an offer to purchase.

  • An order is considered accepted only once payment has been successfully processed and confirmed.

  • We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud or pricing errors.

4. Pricing and Payment

  • All prices are displayed in the applicable currency and are subject to change without notice.

  • Prices do not include shipping fees unless stated otherwise.

  • Payment must be made in full at checkout using the available payment methods.

  • We use third-party payment processors and do not store full payment card details.

5. No Returns, Refunds, or Cancellations

All Ferro Racing products are custom-made upon receipt of an order.

Accordingly:

  • All sales are final

  • No refunds, returns, or exchanges are offered

  • Orders cannot be cancelled once production has begun

Exceptions may apply only in cases where a product arrives damaged, defective, or incorrect, as outlined in our Return & Refund Policy.

6. Shipping and Delivery

  • Delivery timeframes are estimates and not guaranteed.

  • We are not responsible for delays caused by couriers, customs, or events beyond our control.

  • Risk of loss passes to you upon delivery to the courier.

7. User Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and all activity under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.

8. Intellectual Property

All content on the Services, including logos, designs, text, graphics, images, and software, is the property of Ferro Racing or its licensors and is protected by intellectual property laws.

You may not reproduce, distribute, modify, or exploit any content without our prior written consent.

9. Prohibited Uses

You agree not to:

  • Use the Services for unlawful purposes

  • Infringe intellectual property rights

  • Submit false or misleading information

  • Interfere with the security or functionality of the Services

  • Attempt to gain unauthorised access to systems or data

10. Disclaimer of Warranties

The Services and products are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability or fitness for a particular purpose, except where prohibited by law.

11. Limitation of Liability

To the maximum extent permitted by law:

  • Ferro Racing shall not be liable for indirect, incidental, consequential, or punitive damages

  • Our total liability shall not exceed the amount paid by you for the product giving rise to the claim

12. Indemnification

You agree to indemnify and hold harmless Ferro Racing from any claims, damages, losses, or expenses arising from your breach of these Terms or misuse of the Services.

13. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect and process personal information in accordance with applicable laws, including POPIA.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict-of-law principles.

15. Changes to These Terms

We may update these Terms from time to time. Changes will be effective once posted on the website. Continued use of the Services constitutes acceptance of the updated Terms.
